What is a Partner Visa?
The Australian Partner Visa enables foreign nationals in a married or de facto (cohabiting) relationship with an eligible Australian partner to live, work, and study in Australia, with a clear pathway to Permanent Residency (PR).
Common Partner Visa subclasses include:
- Subclass 820/801: For married or de facto partners applying from within Australia.
- Subclass 309/100: For married or de facto partners applying from outside Australia.
- Subclass 300: Prospective Marriage Visa for engaged couples applying offshore.
Eligibility criteria
To be eligible for a Partner Visa, applicants must meet the following requirements:
- Genuine relationship: You must be legally married, have lived together for at least 12 months in a de facto relationship, or have a registered relationship in an Australian state/territory.
- Eligible sponsor: Your partner must be an Australian citizen, permanent resident, or eligible New Zealand citizen.
- Both partners must be aged 18 or over.
- Meet health and character requirements.
- Provide evidence of a genuine and continuing relationship, such as joint bank accounts, shared bills, lease agreements, photos together, etc.
- For Subclass 300: You must intend to marry your partner within 9 months of the visa grant.

For the Applicant:

- Health check results (as required)
- Previous marriage/divorce documentation (if applicable)
- Evidence of cohabitation: rental agreements, bills, joint photos, etc.
For the Sponsor:
- Passport or proof of citizenship/permanent residency in Australia
- Birth certificate and Australian police clearance
- Sponsorship history (if applicable)
Application fees and processing times
- Visa application fee: AUD $9,095 (payable to the Department of Home Affairs).
- Processing time may vary depending on individual circumstances and visa subclass:
