From 2 October 2026, the Australian Government introduced new rules for current Student visa (subclass 500) holders who wish to apply for a subsequent Student visa while in Australia.

Under the new rules, students can only lodge an application in Australia if they meet one of the exceptions specified by the Department of Home Affairs. If they do not meet the relevant requirements, they must lodge their application from outside Australia.

So, if your Student visa is due to expire before you complete your principal course of study, could you qualify for an exception allowing you to apply for another Student visa while in Australia? What do you need to prepare to continue your studies? Find out more in this guide from Next Gem.

Student Visa Expiring Before Course Completion: What Should You Do from 2 October 2026?
Student Visa Expiring Before Course Completion: What Should You Do from 2 October 2026?

1. New Rules from 2 October 2026: Who Can Apply for a Subsequent Student Visa in Australia?

According to the official Department of Home Affairs guidance, from 2 October 2026, current Student visa (subclass 500) holders can only lodge an application for a subsequent Student visa while in Australia if they fall within one of the following six exceptions.

Exception 1: Students who need up to an additional 12 months to complete their current course

Exception 2: Students sponsored by the Australian Department of Foreign Affairs and Trade (DFAT) or the Australian Department of Defence

Exception 3: Students applying to undertake a doctoral degree (PhD)

Exception 4: School students applying to undertake primary or secondary education

Exception 5: Students who have completed their principal course and intend to undertake further study at a higher Australian Qualifications Framework (AQF) level

Exception 6: Students who are unable to continue their course because their education provider has defaulted

If students do not fall within any of these six exceptions, they must lodge a new Student visa application from outside Australia (offshore).

Students Whose Student Visa Is Due to Expire Before They Complete Their Course

Students whose Student visa is due to expire before they complete their current course may fall within Exception 1.

Under Exception 1, students may be permitted to lodge a subsequent Student visa application while in Australia if they meet the following conditions:

  • They need up to an additional 12 months, calculated from the original end date of their principal course, to complete their studies.
  • The course they need to complete must be their principal course in a packaged course arrangement, if they are enrolled in multiple consecutive courses.
  • The course must be provided by the same education provider associated with their current Student visa.
  • If they have changed courses, the new course must be at the same or a higher AQF level than their previous course.

Students who do not meet the specific requirements of Exception 1 must lodge a new Student visa application from outside Australia.

2. Eligible to Apply for a Student Visa Onshore: What Should You Prepare?

Step 1: Identify the Applicable Exception
  • Carefully review your circumstances and determine which exception, if any, applies to your situation.
Step 2: Prepare Evidence to Support Your Eligibility
  • Gather academic transcripts, confirmation letters from your education provider, and other documents demonstrating your study progress and the additional time required to complete your course.
Step 3: Prepare Your Visa Application

In addition to evidence supporting your eligibility for an exception, you should prepare the documents required for your Student visa application, including:

  • A valid Confirmation of Enrolment (CoE) for your intended course of study.
  • Your passport and identification documents.
  • Evidence of appropriate Overseas Student Health Cover (OSHC).
  • Evidence of financial capacity, if required.
  • Academic records and any additional supporting documents required for your application.
Step 4: Review Your Application Before Lodgement
  • Check that you meet the requirements of the relevant exception based on your actual circumstances.
  • Ensure that your CoE, course dates and supporting documents are accurate and consistent.
  • Check the expiry date of your current visa and your intended application timeline.
  • If you are unsure whether you qualify to apply onshore, consider seeking an assessment from an appropriately qualified Registered Migration Agent before lodging your application.

3. Applying for a Student Visa from Outside Australia (Offshore): What Should You Prepare?

Step 1: Determine When to Leave Australia and Where to Lodge Your Application
  • Check your current visa expiry date using VEVO and your visa grant notification.
  • Determine when you will need to leave Australia to lodge your application from outside the country.
  • Allow sufficient time to prepare your documents and plan for visa processing.
Step 2: Prepare Your Study Arrangements

Work with your education provider to:

  • Confirm which part of your current course remains outstanding or identify the new course you intend to undertake.
  • Obtain a valid CoE that reflects your intended study arrangements.
  • Confirm your course commencement date and expected duration.
  • If you are transferring to another education provider or changing courses, ensure that your supporting documents clearly explain the reasons for the change and your study plans.
Step 3: Complete Your Visa Application

An offshore Student visa application must still satisfy the applicable subclass 500 requirements. These may include:

  • Your passport and identification documents.
  • A CoE for your intended course of study.
  • Evidence of appropriate OSHC.
  • Financial evidence, if required.
  • Academic records and information addressing the Genuine Student requirement.
  • Any additional documents requested by the Department of Home Affairs.
Step 4: Plan for the Waiting Period

As an offshore Student visa application does not generate a Bridging visa associated with that new Student visa application, students should make arrangements for the period while their application is being processed.

Consider the following:

  • Discuss your commencement date with your education provider and whether the start date can be deferred if necessary.
  • Budget for travel, accommodation outside Australia and any additional expenses.
  • Check the conditions of any other visa you may hold if you intend to return to Australia while awaiting a decision.
  • Do not assume that a pending Student visa application automatically permits you to enter or remain in Australia.

Important note: If you are required to lodge your Student visa application offshore, you must be outside Australia both when you lodge the application and when the visa is granted. Lodging an application while in Australia without meeting the applicable onshore requirements may result in an invalid application.

From 2 October 2026, lodging a subsequent Student visa application while in Australia is no longer the default option for current Student visa holders. Students should therefore determine whether they qualify to apply onshore or must lodge their application offshore, allowing them to prepare their documents and plan an appropriate study pathway in advance.
